These Terms & Conditions (“Terms”) govern your use of enthoven.art and any purchase of artworks, prints or other products offered by Enthoven (“Enthoven”, “we”, “us” or “our”).

By accessing this website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy.

Please read these Terms carefully before making a purchase.

1. About Enthoven

Enthoven is an independent art studio based in Switzerland, offering original artworks and, where indicated, prints, commissions and other art-related products.

2. The Online Store

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our artworks and products for sale.

We reserve the right to update, modify, suspend or discontinue parts of the website or its contents where reasonably necessary.

Nothing in these Terms limits any rights that cannot legally be excluded under applicable consumer protection law.

3. Original Artworks

Unless otherwise stated, original artworks offered on enthoven.art are unique, one-of-a-kind works created by the artist.

Once an original artwork has been sold, it will no longer be available for purchase.

We make every reasonable effort to describe and photograph artworks accurately. However, colours, textures, surface details and scale may appear differently depending on lighting, photography, screen settings and the device used to view the website.

Small variations between the digital representation and the physical artwork are therefore not necessarily defects.

Dimensions and materials are stated on the relevant artwork page. Please review these details carefully before purchasing.

4. Availability

All artworks and products are subject to availability.

Because original artworks are unique, it is possible in exceptional circumstances that an artwork may become unavailable before the website has been updated.

If an artwork you have purchased is unexpectedly unavailable, we will contact you and refund any amount paid for that artwork.

We reserve the right to limit quantities of prints or other editions where applicable.

5. Orders and Contract Formation

By placing an order, you are making an offer to purchase the selected artwork or product at the stated price, subject to these Terms.

You are responsible for checking the details of your order, including the artwork or product, quantity, price, billing information and delivery address, before completing your purchase.

After placing an order, you will receive an electronic order confirmation.

We reserve the right to refuse or cancel an order in reasonable circumstances, including suspected fraud, payment problems, incorrect pricing, technical errors or an artwork being unexpectedly unavailable.

If we cancel an order after payment has been received, the relevant amount will be refunded.

6. Prices and Payment

Prices are displayed in the currency indicated on the website.

For customers in Switzerland, prices and any applicable charges will be presented in accordance with applicable Swiss pricing requirements.

Shipping charges, where applicable, are displayed separately during the purchasing process or otherwise clearly communicated before the purchase is completed.

For international orders, import duties, customs charges, local taxes and other charges may apply upon arrival in the destination country. Unless otherwise stated or required by applicable law, these charges are the responsibility of the buyer and are not included in the purchase price or shipping charge.

Payment must be made using one of the payment methods available at checkout.

Orders will not be dispatched until payment has been successfully received or otherwise confirmed.

7. Shipping and Delivery

We ship artworks and products to the destinations indicated on our website or agreed with the buyer.

Estimated preparation and delivery times may vary depending on the artwork, destination, carrier, customs procedures and other circumstances outside our reasonable control.

Any delivery times provided are estimates unless expressly agreed otherwise.

Original artworks are packaged with care and, where appropriate, shipped using tracked and/or insured delivery.

The buyer is responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address provided by the buyer may be charged to the buyer where permitted by law.

8. International Orders, Customs and Import Charges

International orders are prepared with the required customs documentation to support a smooth and efficient delivery.

Depending on the destination and shipping service selected, local import VAT, customs duties, brokerage fees or clearance charges may apply. Unless explicitly stated as included at checkout, these charges are not included in the purchase price or shipping contribution and remain the responsibility of the recipient.

Where available, duties-paid delivery may be offered so that applicable import charges can be settled in advance. Any such arrangement will be clearly indicated before purchase.

Customs clearance is handled by the relevant carrier and customs authority. While occasional customs delays remain outside the studio’s control, all required shipment information is prepared carefully to minimise unnecessary delays.

9. Returns and Refunds

Returns and refunds are governed by our Refund Policy.

Where we voluntarily offer a return right, the conditions and time limits stated in our Refund Policy apply.

Nothing in these Terms or our Refund Policy limits any mandatory rights available to you under applicable consumer protection law.

Please contact studio@enthoven.art before returning an artwork or product.

10. Damaged or Incorrect Orders

Every original artwork is inspected and carefully packaged before leaving the studio.

If an order arrives damaged or you receive the wrong item, please contact studio@enthoven.art as soon as possible.

For transit damage, we ask that you contact us within 48 hours of delivery where reasonably possible and provide clear photographs of:

  • the artwork or product;

  • the damage;

  • the external and internal packaging; and

  • the shipping label.

Please retain the original packaging while the matter is being investigated, as the carrier or insurer may require it.

We will work with you to determine an appropriate resolution in accordance with applicable law and the circumstances of the shipment.

11. Commissions and Bespoke Artworks

Where commissions or bespoke artworks are offered, additional terms may be agreed before work begins, including the subject or brief, dimensions, price, payment schedule, estimated completion period, shipping arrangements and the degree of artistic discretion.

The artist retains creative and artistic discretion in the execution of commissioned work within the agreed brief.

Because commissioned and personalised artworks are created specifically for an individual collector, they cannot ordinarily be cancelled, returned or exchanged due to a change of mind once work has begun, except where otherwise agreed or required by applicable law.

Any commission-specific agreement provided to the collector will form part of the contract and, in relation to that commission, will take precedence over these general Terms where the two conflict.

12. Prints and Limited Editions

Where prints or editions are offered, the relevant product page will indicate the available size, material, edition information and other relevant specifications.

For limited editions, the edition size will be stated where applicable.

Minor variations may occur between the appearance of a print on screen and the physical print due to differences in displays, materials and production processes.

Any additional return conditions applicable to prints will be stated in our Refund Policy.

13. Intellectual Property and Copyright

Unless expressly stated otherwise, all original artworks, images, photographs, text, designs, graphics, videos and other creative content appearing on enthoven.art are owned by or licensed to Enthoven and are protected by applicable intellectual property laws.

Purchasing an original artwork, print or commission transfers ownership of the physical artwork or product only.

Copyright and other intellectual property rights in the artwork remain with the artist unless expressly transferred in writing.

The purchase of an artwork does not grant the buyer the right to reproduce, distribute, commercially exploit, create merchandise from, license or otherwise use the image of the artwork for commercial purposes.

Collectors may photograph and display artworks they own for ordinary personal, non-commercial purposes.

Any commercial reproduction or use requires prior written permission.

14. Website Content

You may browse and use this website for personal and lawful purposes.

You may not reproduce, copy, distribute, sell, exploit or commercially use substantial parts of the website or its content without prior written permission.

You may not use the website in a way that interferes with its operation, security or other users, or for unlawful, fraudulent or malicious purposes.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, shipping providers and social media platforms.

Third-party websites and services are governed by their own terms and privacy practices.

We are not responsible for the content, availability, security or practices of independent third-party websites or services, except to the extent required by applicable law.

16. Disclaimer and Limitation of Liability

We take reasonable care to ensure that the information presented on the website is accurate and that artworks and products are appropriately described.

However, to the extent permitted by applicable law, we do not guarantee that the website will always be uninterrupted, error-free or free from technical issues.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by applicable law, Enthoven will not be liable for indirect or consequential losses arising solely from the use or inability to use the website.

Any limitation of liability in these Terms applies only to the extent permitted under applicable law and does not affect mandatory consumer rights.

17. Force Majeure

We will not be responsible for delays or failure to perform obligations caused by events outside our reasonable control, including significant carrier disruption, natural disasters, governmental restrictions, customs delays, strikes, war, civil disturbance or failures of essential third-party infrastructure.

Where such an event affects an order, we will make reasonable efforts to communicate with the customer and find an appropriate solution.

18. Privacy

Personal information is processed in accordance with our Privacy Policy.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Services, policies or applicable legal requirements.

The version that applies to a purchase is generally the version made available to you at the time the relevant contract is entered into, subject to mandatory applicable law.

The current version will be published on enthoven.art together with its “Last updated” date.

20. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

21. Governing Law and Jurisdiction

These Terms and contracts entered into through enthoven.art are governed by Swiss law, subject to any mandatory consumer protection rights that apply based on the customer’s place of residence.

Nothing in these Terms deprives a consumer of any mandatory rights concerning jurisdiction or applicable law that cannot legally be waived.
